  • Who pays — Because parents with primary physical custody are presumed to pay for most everyday costs, noncustodial fathers and mothers are required to make child support payments.
  • Setting a rate — When the combined income of both parents is $148,000 or less, child support obligations are based on a percentage of the noncustodial parent’s income and the number of children he or she has. The contribution that the paying parent makes toward their son’s or daughter’s health insurance, childcare and educational costs is also tabulated. For situations where the combined income level exceeds $148,000, this formula can serve as a guideline, but other arrangements can always be made.
  • Termination — New York law, unlike the laws of some other states, provides for child support through the age of 21 unless a parent demonstrates that their son or daughter has established financial and/or legal independence. Of course, many young adults are still in college when they reach that age, so our firm can attempt to negotiate an agreement covering education costs.
